Dispensary Sues Insurance Companies Over Medical Cannabis

The complaint says the cost of medical cannabis must be fully covered by insurance.

A major New Mexico cannabis dispensary is suing multiple health insurance providers over coverage of medical marijuana.

Ultra Health, along with six individuals, has filed a class-action lawsuit against Blue Cross and Blue Shield, Cigna and five other providers.

The lawsuit seeks a determination that medical cannabis is a healthcare service for treatment of behavioral health conditions.

The complaint states that, under a new statute effective Jan. 1, 2022, the cost of medical cannabis must be fully covered by insurance.

In addition to seeking reclassification of medical cannabis, plaintiffs are seeking awards covering costs of medical cannabis from January 1.

The lawsuit pits one of New Mexico’s largest cannabis companies against several of the biggest medical insurance providers.

Ultra Health owns and operates 28 licensed medical marijuana dispensaries throughout the state of New Mexico.
