After High-THC Product Lands Him in the Hospital, Man Sues Dispensary

He said he experienced “muscle spasms, psychomotor agitation, extreme discomfort, nausea and vomiting.”

An Oregon man has filed a $10,000 lawsuit against a dispensary after a THC product it sold landed him in the emergency room.

According to the complaint, Skye Fitzgerald purchased a bottle of THC syrup from the dispensary and an employee advised him to “follow the directions on the bottle” by taking “about a capful.”

Fitzgerald consumed about one teaspoon of the syrup, which the report said equaled about 40 milligrams of THC.

He said it caused him to experience “muscle spasms, psychomotor agitation, elevated heart rate, extreme discomfort, shortness of breath, nausea and vomiting.”

The lawsuit claims doctors diagnosed Fitzgerald with “THC overdose” after observing him have difficulty walking without help.

Arcanna, the retailer targeted in the lawsuit, said it’s not at fault since it was simply selling a product approved by Oregon regulators.
