California Recalls Infused Pre-Rolls Over Labeling Inaccuracies, Aspergillus

The company posted a certificate of analysis which shows the products passing all tests.

Last Thursday, California's Department of Cannabis Control (DCC) issued a mandatory recall for three Creme Genetics Infused Pre-Roll products due to the potential presence of Aspergillus flavus, a fungus that can cause aspergillosis in humans, and inaccurate labeling that reports more THC than the product contains.

The strawberry creme cones were manufactured by Studio Caregivers in Los Angeles and distributed by UC Advisor Corporation, which is doing business as Snap Distro SV, according to DCC. 

The affected products include the 1.1-gram pre-roll, the four-pack of 1.1-gram pre-rolls and the four-pack of 0.5-gram pre-rolls. The products were sold after October 23, 2023, at 34 different dispensaries.

In a statement posted on the Creme Genetics website, the company says it was notified of the recall on April 24, 2024. Creme says any consumers still possessing its Strawberry Cone Batch #SCC019 should stop using it immediately and notify the retailer.

Creme Genetics says it uses an independent third-party lab for all product testing prior to release. The company posted the Certificate of Analysis (COA) from CC Testing Labs in Northridge, CA, which shows the batch passing all tests. 

DCC confirmed Aspergillus flavus and inaccurate THC content labeling in the following batches: UID Number 1A4060300002CF8000000552, 1A4060300047BA9000000316 and 1A4060300047BA9000000317. 

Labeling Inaccuracies

Creme says the DCC also sampled and analyzed the batch for cannabinoids and determined that the infused pre-roll contains 19.8% total THC. The product label states the product contains 35.2% total THC, which represents a difference of 43.75% and is significantly greater than the allowable variance of 10%. 

According to the COA provided by Creme, CC Testing Labs reported 35.2% total THC. 

The batch doesn't meet the standards established in the California Code of Regulations and is, therefore, adulterated and misbranded.
