The Colorado Department of Revenue (DOR), in conjunction with the Colorado Department of Public Health and Environment (CDPHE), is issuing a Health and Safety Advisory due to the identification of contaminated Retail Marijuana Flower (bud/shake/trim) produced and sold by Medpharm Holdings, LLC, d.b.a. Bud & Mary's Cannabis.

The CDPHE and DOR deem it a threat to public health and safety when marijuana is found to have Total Yeast and Mold above the acceptable limits established in Colorado Marijuana Rule 4-215. This advisory includes Harvest Batches tested and found to have exceeded acceptable limits established for Total Yeast and Mold.

Medpharm Holdings, LLC collaborated with the Marijuana Enforcement Division (MED) to initiate a voluntary recall for the affected Harvest Batches. The affected product is listed below (by license number and Harvest Batch) and was sold between February 7, 2024, and December 20, 2024.

“At Bud & Mary’s, quality and safety are our top priorities," said Lucas Nelson, group president of Bud & Mary’s, in a statement to Cannabis Equipment News. "A recent test at the retail level identified microbial contamination in a batch of our flower. Before release, this batch passed all testing requirements using state-approved third-party labs. On December 27, 2024, more than a month before the advisory went out, we voluntarily contacted all retailers carrying the affected batches, providing guidance on proper destruction in accordance with MED regulations."

Nelson said the company is working closely with the MED to review and strengthen its processes to prevent future issues, including auditing procedures, exploring enhanced testing, and investing in new technologies.

"We remain committed to transparency, compliance, and delivering safe, high-quality cannabis to our customers," Nelson added.

Individuals who possess this affected product should destroy it or return it to the store from which it was purchased for proper disposal. Individuals who experience adverse health effects after consuming the affected product should seek medical attention immediately and report the event to the MED by submitting a MED Reporting Form.

All Regulated Marijuana must have a label affixed to the container that, at a minimum, indicates the license number of the Regulated Marijuana Business that cultivated the marijuana, and the Harvest Batch number assigned. Individuals should check the label of their flower for the following license number and Harvest Batch numbers.
