Montana is preparing cannabis companies in the state for updated regulations that go into effect on July 1, 2026.
Passed on May 8, 2025, Montana House Bill 792 imposes new requirements on all dispensaries, which must update exit packaging to include revised warnings. These warnings must be placed next to the universal marijuana symbol. Additionally, an addiction resource link (QR code) must now be printed on all exit packaging.
The updated warnings for the exit bags must be verbatim and printed in black ink against a white background.
WARNING: Consumption of marijuana may cause anxiety, agitation, paranoia, psychosis, and excessive vomiting.
WARNING: Consumption of marijuana by pregnant women may result in fetal injury and low birth weight.
WARNING: Consumption of marijuana by nursing mothers may result in infant hyperactivity and poor cognitive function.
WARNING: Driving while under the influence of marijuana is a crime.
Additionally, dispensaries must display new consumer education posters (at any point-of-sale) with the updated exit warning messages, the universal warning symbol, and the website address, phone number, and QR code for an available resource for overcoming marijuana addiction.
Also passed on May 8, 2025, Montana House Bill 636 establishes new maximum restrictions on single-serving size potency for marijuana-infused ingestible products. The maximum milligrams per serving package will be reduced from 10 mg to 5 mg of THC.
Packages created and labeled before July 1, 2026, may not be "sold through" after that date. Packages that may have already been produced in accordance with the new 5 mg-per-serving package regulation would not be subject to this guideline or directive.
Licensees are responsible for ensuring all inventory is compliant before the deadline.
